Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the PlanProve website at planprove.com(the "Platform"), operated by PlanProve ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

You must be at least 18 years old and based in the United Kingdom to use the Platform. By registering, you confirm that you meet these requirements.

3. What PlanProve provides

PlanProve is a project management platform for planning professionals ("Professionals"). Professionals use the Platform to manage planning projects, track application progress and statutory deadlines, store project documents, and issue invoices.

A Professional may invite the homeowner or other client they act for (a "Client") to follow a project. A Client receives an account only by accepting such an invitation, and that account provides read-only visibility of what the Professional has chosen to share. PlanProve does not operate a directory or marketplace of Professionals, and does not match, introduce, or recommend Professionals to Clients.

We do not provide planning advice, architectural services, or any professional services ourselves. We are not a party to any agreement between a Client and a Professional.

4. Account types and responsibilities

All users must:

  • Provide accurate and truthful information.
  • Keep their account credentials secure.
  • Notify us immediately if they suspect unauthorised access to their account.
  • Use the Platform only for its intended purpose and in accordance with applicable laws.

Clients

Clients access the Platform by accepting an invitation from the Professional acting for them, in order to follow the progress of that project. Clients do not search for, select, or engage Professionals through the Platform — that relationship is agreed between them separately. Information a Client gives their Professional should be accurate and complete.

Professionals

Professionals use the Platform to manage their own planning projects and to share progress with their Clients. Professionals are responsible for holding appropriate qualifications and insurance, for delivering services to a professional standard, and for the accuracy of the project information they record and share. Professionals must not misrepresent their qualifications or experience.

5. Subscriptions and payments

Professional accounts require a paid subscription to access certain features of the Platform. Subscriptions are managed and billed through Stripe. By subscribing, you agree to Stripe's terms of service.

  • Subscription fees and billing cycles are displayed at the time of purchase.
  • Subscriptions renew automatically unless cancelled before the end of the current billing period.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and no refund is given for the remaining period.
  • We reserve the right to change subscription pricing with reasonable notice. Price changes will apply from your next billing cycle.

PlanProve does not itself process, hold, or transmit payments. Payment processing is provided by Stripe, our third-party payment processor, via Stripe Connect. When a Client pays an invoice through the Platform, the payment is created directly on the Professional's own Stripe-connected account rather than passing through PlanProve. PlanProve does not receive, hold, or have access to Client card or payment details.

Merchant of record, fees, refunds and disputes

Because invoice payments are created on the Professional's own Stripe account, the Professional is the merchant of record for those payments. In practice this means:

  • Stripe's standard processing fee is deducted from each payment before it reaches the Professional. PlanProve adds nothing on top.
  • Refunds are issued by the Professional from their own Stripe account. PlanProve does not change the invoice status automatically when a refund is made.
  • If a Client disputes a payment, Stripe contacts the Professional directly and handles it with them, and Stripe's dispute fee is charged to the Professional's account. PlanProve is not a party to the dispute and does not carry the liability for it.

Use of payment features is also subject to Stripe's own terms of service.

6. User content

You retain ownership of all content you upload to the Platform (including messages, documents, images, and project details). By uploading content, you grant us a limited licence to store, display, and transmit that content as necessary to provide the Platform services.

You must not upload content that:

  • Is unlawful, defamatory, abusive, threatening, or discriminatory.
  • Infringes the intellectual property rights of any third party.
  • Contains malware, viruses, or any other harmful code.
  • Is spam, unsolicited advertising, or promotional material.

We reserve the right to remove content that violates these Terms.

7. Prohibited conduct

When using the Platform, you must not:

  • Impersonate any person or misrepresent your affiliation with any entity.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Use the Platform to harass, abuse, or harm other users.
  • Scrape, crawl, or use automated means to access the Platform without our written permission.
  • Circumvent or attempt to circumvent any Platform restrictions, access controls, or subscription limits.
  • Use the Platform for any illegal purpose.

Violation of these rules may result in suspension or termination of your account.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis. While we strive to provide a reliable service, we do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components.

We do not vet, endorse, or guarantee the work of any Professional on the Platform. PlanProve does not introduce or recommend Professionals to Clients, and a Client's decision to engage a Professional is made independently of the Platform. Any contract for services is between the Client and the Professional directly.

We do not provide planning advice or professional opinions. Any information on the Platform is for general informational purposes only and should not be relied upon as professional advice.

9. Limitation of liability

To the fullest extent permitted by law:

  • PlanProve shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • PlanProve shall not be liable for any loss arising from the actions, omissions, or conduct of any user, including Professionals.
  • Our total liability to you for any claim arising from or relating to these Terms or the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Account suspension and termination

We may suspend or terminate your account if you breach these Terms, engage in prohibited conduct, or if we reasonably believe your continued use poses a risk to the Platform or other users.

You may request deletion of your account at any time through your account settings. How the request is then completed depends on the type of account:

  • Client accounts are deleted automatically after a 30-day grace period, during which the data is retained and the request can be withdrawn.
  • Professional and practice accounts are currently completed manually rather than automatically. Your request is recorded immediately, and we will complete the deletion within 30 days. Manual handling is necessary because a professional account may be linked to a practice, to invoices retained as statutory financial records, and to case files for which the professional is the data controller. You can withdraw the request at any time before it is completed.

Records subject to a statutory retention period — in particular invoices and payment records, kept for 6 years from the end of the relevant accounting period — are retained for that period and are not removed by an account deletion. 11. Intellectual property

All intellectual property rights in the Platform (including its design, code, branding, and content created by us) belong to PlanProve. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

12. Disputes between users

PlanProve is not responsible for resolving disputes between Clients and Professionals. If a dispute arises, we encourage users to communicate directly and resolve matters amicably. We may, at our sole discretion, offer assistance but are under no obligation to do so.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
